Virginia Governor Signs Bill to Expand Access to Dental Care

Exam1On March 13, Gov. Terry McAuliffe (D-VA) signed into law HB 1474, which amends the Virginia Code on the practice of dental hygiene and remote supervision. The new law makes the following changes:

  • Eliminates the requirement that a dental hygienist providing dental hygiene services under remote supervision be employed by the supervising dentist.[1]
  • Clarifies continuing education requirements for dental hygienists practicing under remote supervision.
  • Eliminates the requirement for written permission to treat a patient from a dentist who has treated the patient in the previous 12 months.
  • Allows a dental hygienist practicing under remote supervision to treat a patient who provides verbal confirmation that he or she does not have a dentist of record whom he or she is seeing regularly.
  • Eliminates the requirement that a dental hygienist practicing under remote supervision consult with the supervising dentist prior to providing further dental hygiene services if the patient is medically compromised or has periodontal disease.
  • Allows a dental hygienist practicing under remote supervision to provide further dental hygiene services in accordance with a written practice protocol developed and provided by the supervising dentist, which shall consider, at a minimum, the medical complexity of the patient and the presenting signs and symptoms of oral disease.
  • As a result, the new law directs the Board of Dentistry to promulgate regulations to implement the provisions of the act within 280 days of its enactment.

[1] Under the new law, remote supervision means that a supervising dentist is accessible and available for communication and consultation with a dental hygienist during the delivery of dental hygiene services, but such dentist may not have conducted an initial examination of the patients who are to be seen and treated by the dental hygienist and may not be present with the dental hygienist when dental hygiene services are being provided.
