FTC Weighs in on Texas Dental Board Rules Concerning Dental Service Organizations

In a letter dated October 6, the Federal Trade Commission (FTC) responded to an invitation for public comments on two rules proposed by the Texas State Board of Dental Examiners (Board).

The proposed rules at issue are as follows: Proposed 22 TEX. ADMIN. CODE §108.70 imposes new restrictions on the ability of Texas dentists to enter into contracts with “unlicensed persons” for the provision of nonclinical services, such as administrative support and business functions.

Governor of California Signs Teledentistry Bill into Law

On September 27, Gov. Jerry Brown (D-CA) signed into law A.B. 1174. The new law adds teledentristy to a list of specialty health care services for which face-to-face contact is not required in order to claim reimbursement from Medi-Cal, the state’s Medicaid program. The legislation will take effect on January 1.
