CMS Extends Affordable Care Act Enrollment Period to Allow Taxpayers to Avoid Fine

On Feb. 20, the Centers for Medicare & Medicaid Services (CMS) announced a special enrollment period for individuals and families who did not have health coverage in 2014 and are subject to the fee or “shared responsibility payment” when they file their 2014 taxes in states that use the federally facilitated marketplace (FFM).

Update on State Medicaid Expansion under the Affordable Care Act

Twenty states and the District of Columbia plan to expand their Medicaid program under the Affordable Care Act (ACA), according to information provided by the Commonwealth Fund. Under the ACA, as of January 1, 2014, Medicaid eligibility will be expanded to reach all children and adults under age 65 with incomes at or below 133% of the federal poverty level.

The Commonwealth of Kentucky, Franklin Circuit Court issued two opinions on September 3 in David Adams, et al. v. Commonwealth of Kentucky, et al. The first upheld the authority of Gov. Steve Beshear (D-KY) to create a health insurance exchange/marketplace under the Affordable Care Act (ACA), and the second upheld the governor’s authority to expand Medicaid under the ACA.

New Mexico Asks the Federal Government for Help with Operating the Health Insurance Marketplace Before the October 1 Deadline

On May 17, the New Mexico Health Insurance Exchange Board met and determined that New Mexico would run a hybrid state-federal partnership exchange, instead of the state-based exchange model the state received conditional approval by the U.S. Department of Health and Human Services to operate.
